Actually no, that wasn't my lame attempt at flamming you, I wanted to write a response to your point which was all of a whole page ago by then and grabbed the first post of yours I found.  Defensive much?

And once again, just for you, a C&D letter doesn't scare anyone working on the project, they've taken steps and they know how to respond so even if one is sent they know where they stand and they know what to do.

Does anyone have anything NEW to add?

How would VU file appropriate court forms when no infringement can be found anywhere?  Would they just put: "we think that hero6.com is violating our copyright, but we aren't sure; nor can we specify where said violations have occurred ?
I bet their legal department can whip up something better than *that*, but basically when they file the suit, they don’t really need to go into specifics, only claim a violation exists. They can say something general along the lines of “contains unauthorized use of copyrighted material, including, but not limited to, similar and/or same characters and/or themes and/or game interface”.

Failing to prove that another party has not violated copyright infringement means that all legal fees accrued would fall back on the plaintiff. Given this fact, how would hero6 be financially screwed if VU chose to pursue us?  Hero6 could even get our own legal representative and have VU pay such expenses when they loose disastrously in court.
Polagro pretty much answered this one. Win or loose, fighting off a lawsuit is a usually a lengthy & costly business, and much more devastating for the poor individual than for the rich corporation with the legal department and lawyers on retainer.
Well. If they suck a reason out of their thumbs, what will happen when we simply ignore it? Like was said previously: a C&D isn't a court-order. It is only a warning.

We don't have a leader at Hero6. They'll have to send a letter to everyone. If I receive a letter today, perhaps I'll get a scare and I'll leave Hero6. That doesn't prevent anyone else from going on.

Shutting down the site would do nothing to the project. A new site will probably pop up.

But that's only in the worst case scenario. It sounds like people see VU going on some rampage!Huh They've been closing down projects on a regular basis for the last 6-7 years (which we are aware of).

We got you the first time, Storm. And yes, we are aware that copyright issues aren't all that clear-cut. Please take our word for it that this issue has been discussed before and we do have a plan.

Tell you what. If you guys get email of a C&D from Viv, just forward it to me. I'll reply with a devastating barrage of eye-hurting material. Details will remain hidden until further notice. If VU doesn't back off...then we summon Jigen to assassinate their CEO and steal all their copyrights. THEN we take all the copyrights we don't want and auction  them off over E-Bay for millions.

What Cosair said can be Plan B,

Plan A can be to continue and not worrying about recieving a C&D.

Sorry, I must have gotten confused there. You see, where I come from, usually when people want to abbreviate someone's quote, they use "..." (In fact, I've just done that up there, it's really simple). It's only when they're trying to flame someone and mock their opinion, that they bother to replace the quoted words with a whole lot of "blah blah blah".
But hey, I'm new here, so I wouldn't know. Maybe implicitly insulting people just because you don't like what they have to say (or just because you're an immature ass, I don't know you personally) is the norm around this forum.

From some of the responses I've been getting here, I see several posters didn't get me the first time, nor the second or third. However, seeing how I've answered pretty much everything in my previous posts, explaining further at this point would be repeating myself, so I'll just leave it at that.
I sincerely hope no one has been unduly panicked or caught up in any misconceptions, and that whatever plan you have for fighting an improbable C&D letter would never have to be applied rolleyes

I was skipping over the details, like I said, I only quoted your post because I wanted to show who I was talking too (and I'm not that big a fan of writing it as 'Storm:' like a theatre script). The 'blah, blah, blah' part was just me skipping over the details.

I also like how you concentrate entirely on the 'blah, blah, blah' and ignore the actual point I made in the post itself. Let's hear it for focusing on the little things.

Oh yeah, this is one relevant conversation we're having here.

Break it up you two, Hero6 being spammed mercilessly by my good self is bad enough, we don't need a flame war too. Storm, go shut up and sit down. Jigen...just sit down and post in other threads, you're getting way too worked up over this.

The temptation to say how the pot is calling the kettle black here is just ssoooooooooooo strong right now. But only because you're right (not about the worked up part, but I forgive you  Cheesy) I'll take your advice this time.

Jiggy listens to what I say? What miracle is this? Is the earth splitting open? Someone check the temperature of hell, I bet it's at most, 32 degrees farenheit.
