Reposted from elsewhere, not written by me. CONFIRMED BEYOND QUESTION:
The SQ3 "cease and desist" was a lie.
Khaveen, the director of the project, has publicly stated that he never received any such letter, and that he told Alias (who is also known as "Rog" and "Robin") to close the project because of lack of progress.
Alias then decided to take advantage of the c&d received by KQIX... and lied to the entire gaming community, stating that Khaveen had received a c&d. Since he was the webmaster of the SQ3 site, he took down the site entirely when asked to provide proof of his statement. He continued to lie even in the face of some tough questions and some scepticism shown towards him by fellow members of the team and others.
This needs to be made as public as Alias's statement that they'd been closed down by VU.
His motive? We can only guess, since Alias has not posted since Khaveen exposed the lie for what it is. But the likeliest explanation is that he thought this was a way to gain sympathy, and to excuse the lack of progress without having simply to say, "We overestimated our resources and we're not going to continue." So there isn't a sudden rash of projects receiving a C&D letter from VU, only projects with set release dates and definite copyright infringement.

A C&D letter is a threat of legal action, it is not a court date summons. If hero6 was to mistakenly receive one of these we would just have to write back and let them know that they are mistaken and that hero6 contains no proprietary materials of theirs, since it does not. If they still wish to take us to court they would have no case.
We are pleased that you are concerned about the fate of hero6, however we have made sure at this point that there is no copyright infringement whatsoever. Therefore, there are no grounds for a case against us and a C&D letter cannot be sent out if their lawyers are on the ball.
It's interesting that LucasArts has relaxed their former rules about fan works. I hope that Vivendi will do the same at some future date as fan works can be allowed in such a way as to keep the intellectual property rights where they belong. If Vivendi's lawyers would concentrate on that rather than on shutting down fanprojects it would be a better result for projects such as KQ9 and for Vivendi itself.

I was definately interested in playing kq9, but IMO, after seeing that teaser movie, I don't feel like we're missing out much. Maybe it is just me, but the movie clip was so horifically cheesy, I was embarrased to be seen watching it. Ehhh, have you played QFG or KQ lately? Cheese is rather essential to the early adventure games' ambience. Therefore, cheese is important in a fangame. Have a look at the copyright at the bottom of AGDI's website, and you'll see how they are allowed to keep making remakes. Pity KQ9 can't do the same thing if it is true enough to KQ.

Miros is from the Greek language, and for Herocia's Miros is his first name and the only name we know him by. So the fact that other real people have the last name of Miros isn't an issue. We don't exactly have a copyright on his name, however due to the fact that people from Herocia are involved in the RPS it did get rather confusing.
If you want to use the name Miros for a bad guy elsewhere it would be nice to distinguish him/her from Herocia's Miros. Maybe change a letter, or have a different first name, or different last name, etc. Just something so that when I see the word "Miros" I don't go "wtf, what does Miros have to do with this, are they talking about Herocia in here?"

HOIK was programmed in two weeks using MOSTLY pre-existing art, and pre-existing music. The writing was done in 12 days. The voice acting was done in 3 days. That is still quite impressive, particularly for an online team scattered all over the globe and in different timezones.
The team of HOIK probably could have made the entire game from scratch if we all worked fulltime on game development. But that would of course require funding, and there's no funding for free games.
